Introduction to Part IXA
Part IXA of the Constitution, which came into force on 1 June 1993, provides a constitutional foundation to the local self-government units in urban areas. Such institutions already existed throughout the country, but this amendment granted them constitutional recognition.
Many provisions under this Part are similar to those contained in Part IX, including:
Reservation of seats
Finance Commission
Election Commission
This Part establishes two types of bodies:
Institutions of self-government (Article 243Q)
Institutions for planning (Articles 243ZD and 243ZE)
Institutions of Self-Government (Municipalities)
Under Article 243Q, municipalities are categorized into three types:
Nagar Panchayat – for a transitional area moving from rural to urban status
Municipal Council – for a smaller urban area
Municipal Corporation – for a larger urban area
It is obligatory for every State to constitute such units. However, if an urban area or part of it already receives municipal services from an industrial establishment, the Governor may declare it an industrial township, in which case constituting a municipality is not mandatory.
